Microsoft has been granted a stay on a court injunction that would
have stopped the software giant selling its Word application.
The US Court of Appeals for the Federal Circuit handed Redmond the
temporary reprieve yesterday, after it ruled MS had done enough to
deserve a stay of the injunction.
Microsoft applied for a speedy review of its appeal as well as the
stay of the injunction a fortnight ago.
Canadian software maker i4i Ltd won a long-running patent legal spat
against Microsoft in a US district court in Texas on 12 August.
MS was slapped with a $290m fine and issued with an injunction that
prevented the multinational from selling 2003 and 2007 versions of
Word that come loaded with i4i’s alleged patent XML tech.
The injunction would have kicked off in mid-October, as a judge set it
to take effect 60 days from the ruling.
A hearing at the Court of Appeals for the case has been set for 23
September. ®
